Privacy Policy

1. Datacontroller

Nordisk Film Production A/S, Mosedalvej 14, 2500 Valby, CVR nr.: 25 68 81 63 collects and processes your personal data.
 

2. Information, purpose and retention period

The information, purpose as well as the period we retain and process your personal information depends on your engagement at Nordisk Film Production A/S.

A. Rights owner (scriptwriter, derector, actor, photographer, composer and editor)

Categories of information:

We collect and process the following personal information:

Name, address (personal and business), e-mail, phone number, national identification number, bank information, information regarding union membership (only for scriptwriter in order to honor the collective agreement), health information (only actors and crew members), photo/stills/castingvideos (only actors), shoe and clothing sizing, creditcardnumber, passport number, criminal record as well as children certificate (when working with underage children).

In regard to actors, we also process the image and acting performance that appears in the production.

We receive the data directly from you in connection with your involvement in the production.

Purpose and legal basis for processing:

  1. Contract negotiation
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation.
       
  2. Payment of salary, fees, royalty as well as other profit share
    • This processing of information is based on section 11(2) and 11(3) of the Danish Data Protection Act and Article 6(1)(c) of the General Data Protection Regulation.
       
  3. Production related acts such as budgets, productionsplans, crewlist, creditlist (including IMDB), guestlists and giftlists
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation.
       
  4. Obtaining criminal record, children’s certificates, health information as well as insurance policies
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation.
       
  5. Distribution- and sales related acts including chain-of-title preparation and marketing acts
    • This processing of information is based on the contract as well as the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation

 

Rentention period

For rights holders and partners who jointly own the production, we store the relevant personal data for the period during which the production is protected by copyright under the Danish Copyright Act. According to section 63(1) of the Danish Copyright Act, the term of copyright protection for film works is 70 years after the death of the longest surviving author.

Actors photo and performance in the production is stored without temporal limit.

Regardless of the above-mentioned affiliation, the following personal data will be deleted immediately after the completion of the production: health information, photos, castingfilm.
 

B. Extras

Categories of information:

We collect and process the following personal information:

Name, address, telephone number, personal identification number, photos in connection with the participation in the production.

We receive the data directly from you in connection with your involvement in the production.

 

Purpose and legal basis for processing:

  1. Contract negotiation
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation
       
  2. Payment of salary
    • This processing of information is based on section 11(2) and 11(3) of the Danish Data Protection Act and Article 6(1)(c) of the General Data Protection Regulation.
       
  3. Production related acts such as crewlist, guestlists and giftlists
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation
       
  4. Obtaining criminal record and children certificates
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation

 

Rentention period

We store the contracts for extras for 5 years from the year in which you have participated as an extra in accordance with the Danish Bookkeeping Act.

Your participation in the production is stored without temporal limitations.

Other information collected in connection with your participation will be deleted immediately after the end of the production.

 

C. Financial partners (co-producers, investors etc.)

Categories of information:

We collect and process the following personal information:

Name, address (privat and business), e-mail, telephone number, personal identification number, bank information.

We receive the data directly from you in connection with your involvement in the production.
 

Purpose and legal basis for processing:

  1. Contract negotiation
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation
       
  2. Payment of profit share
    • This processing of information is based on section 11(2) and 11(3) of the Danish Data Protection Act and Article 6(1)(c) of the General Data Protection Regulation.
       
  3. Production related acts such as budgets, guestlists and giftlists
    • This processing of information is based on the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation
       
  4. Distribution- and sales related acts including chain-of-title preparation and marketing acts
    • This processing of information is based on the contract as well as the rule of legitimate interest in Article 6 (1) (f) of the General Data Protection Regulation

 

Rentention period

The relevant personal data is stored in accordance with the consent obtained in connection with the conclusion of the Contract.

 

3. Transfer of information

We may disclose or transfer your information to thirdparties including but not limited to:

  • Public authorities, including municipalities and SKAT in connection with payment of salary, the Labour Market Insurance in connection with work-related injuries, etc.
  • Payroll companies
  • Pension companies
  • Insurance brokers and companies
  • Travel agents
  • Counsellors and representatives
  • Distributors, broadcasters, streaming services and other purchasers of film rights
  • Hosting companies
  • Other data processors


Transfers required by law are done in accordance with Article 6 (1) (c) of the General Data Protection Regulation (compliance with a legal obligation).

Other transfers are done in accordance with the contract, Article 6 (1) (b) or legitimate interest in Article 6 (1) (f) of the GDPR.

It may be necessary to transfer your data to countries outside the EU/EEA, e.g. in connection with foreign distribution of production. We try to minimize the amount of personal data we transfer and thus only disclose what is necessary to exploit and distribute the production.

In addition, we reserve the right to use or disclose information to the extent necessary to comply with applicable laws, to investigate complaints, to respond to your requests or for investigative purposes.

To the extent possible, in addition to reference to Nordisk Film Productions' privacy policy, reference will also be made to the privacy policy of third parties.

 

4. Your rights

You may at any time obtain a summary of the personal information related to you which we process, rewuest that your personal information is rectified or corrected and in some instances deleted by contacting us.

You can also request data portability, restriction of processing or object to our processing of your personal data.
